If you worked as a Delivery Driver in California from May 30, 2015, through February 4, 2025, you are entitled to receive money from a class action settlement.

The settlement resolves a class-action lawsuit, Guillermo Palatto, et al. v. Safeway Inc., Groceryworks.com, LLC, and Groceryworks.com Operating Company, LLC (the “Action”), which alleges that: (a) Class Members were not paid for all time worked, including minimum wages and overtime wages; (b) Class Members were not provided meal breaks in compliance with California law; (c) Class Members were not paid premium wages for alleged missed, short, and/or late meal breaks; (d) Class Members were not provided with accurate itemized wage statements; and (e) Class Members were not paid all wages owed upon termination. Plaintiffs alleged that such alleged practices entitled Plaintiffs and all PAGA Employees to recover amounts pursuant to PAGA.

Please read the Notice carefully. The Notice relates to a proposed settlement of class action litigation. If you are a Class Member, it contains important information about your right to receive a payment from the Settlement Fund.

Your Legal Rights and Options in this Settlement

Do Nothing and Receive Payment

Get a payment and give up your legal rights to pursue claims released by the settlement of the Lawsuit.

Opt Out of the Settlement

Exclude yourself from the Settlement, get no payment, and retain your legal rights to pursue claims that would otherwise be released by the settlement of the Lawsuit.

Object to the Settlement

If you do not opt out, you may write to the Settlement Administrator, Simpluris, about why you object to the settlement and they will forward your concerns to counsel which will then be provided to the Court. If the Court approves the Settlement despite your objection, you will still be bound by the Settlement.

If you timely object, you or your attorney may also address the Court during the Final Approval hearing scheduled for July 22, 2025, at 2:30 p.m. in the Alameda County Superior Court, located at 1225 Fallon Street, Oakland, CA 94612.

The Court still will have to decide whether to approve the Settlement. Payments to class members will be made if the Court approves the Settlement and after any possible appeals are resolved.
